1. Acceptance of Terms

By creating an account, accessing, or using our Service, you:

  • Confirm you are at least 18 years old or have parental consent
  • Agree to comply with these Terms and our Privacy Policy
  • Represent that you have the authority to enter into this agreement
  • Acknowledge that these Terms constitute a binding legal agreement

Imagable is a comprehensive AI image platform that provides:

  • AI-powered image generation from text prompts
  • AI image editing and enhancement tools
  • Image upscaling, background removal, and image-to-prompt services
  • Photo enhancement and professional editing capabilities
  • User account management and generation history
  • Credit-based and subscription-based access models

3. User Accounts

Account Creation

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access
  • One person or entity may maintain only one account

Account Responsibilities

  • You are solely responsible for all activities under your account
  • You must not share your account with others
  • You must comply with all applicable laws and regulations
  • You must not use automated systems to access the Service without permission

4. Service Plans and Credits

Free Plan

  • Registered users receive 50 free tool uses per day
  • Access to Image Upscaler, Background Remover, and Image-to-Prompt tools
  • Free account registration required
  • Subscription plans provide monthly credit allowances and 500 free tool uses per day
  • Credit packs offer one-time purchases that never expire
  • Paid users receive 500 free tool uses per day for all free tools
  • All premium AI tools access included in paid plans

Credit System

  • AI Image Generator and AI Image Editor: 2 credits per operation
  • Photo Enhancer: 1 credit per operation
  • Credits never expire for one-time purchases
  • Subscription credits are added monthly and don't expire

5. Acceptable Use Policy

Permitted Uses

You may use our Service to:

  • Generate images for personal or commercial use
  • Edit and enhance existing images
  • Create content that complies with applicable laws
  • Access and download your generated content

Prohibited Uses

You may not:

  • Create content that is illegal, harmful, or violates others' rights
  • Generate content containing violence, hate speech, or adult material
  • Create deepfakes or misleading content of real people without consent
  • Impersonate others or provide false information
  • Attempt to reverse engineer or copy our AI models
  • Use the Service for spam, phishing, or malicious activities
  • Violate intellectual property rights of others
  • Circumvent usage limits or security measures
  • Generate content that infringes on copyrights or trademarks

6. Content and Intellectual Property

Your Content

  • You retain ownership of content you create using our Service
  • You grant us a limited license to process and display your content as necessary to provide the Service
  • You are responsible for ensuring you have rights to any input content (text, images, etc.)
  • You represent that your content does not infringe on others' rights

Our Content

  • We retain all rights to our AI models, software, and platform technology
  • Our Service, including all intellectual property rights, remains our property
  • You may not copy, modify, or distribute our proprietary technology
  • Trademarks, logos, and branding materials are our property

Generated Content

  • Content generated using our AI models is created based on your prompts
  • You have commercial rights to use generated content subject to these Terms
  • We do not claim ownership of your generated content

7. Payment Terms

Pricing

  • Current pricing is available on our website and may change with 30 days notice
  • Subscription fees are charged in advance for the applicable period
  • Credit pack fees are charged at the time of purchase
  • Taxes may apply based on your location

Payment Processing

  • Payments are processed through our payment partner Creem.io
  • We accept major credit cards and other specified payment methods
  • Failed payments may result in service suspension
  • You are responsible for keeping payment information current

Refunds

  • Refund requests must be submitted within 30 days of purchase
  • Refunds are generally not available for used credits or services
  • Unused credit packs may be eligible for refund at our discretion
  • Subscription refunds are prorated for unused time
  • Refunds are processed within 5-10 business days

8. Usage Limits and Fair Use

Service Limits

  • Usage limits are based on your subscription plan or credit balance
  • Free users: 50 free tool uses per day
  • Paid users: 500 free tool uses per day plus purchased credits
  • We may implement reasonable usage limits to ensure fair access

Fair Use Policy

  • The Service is intended for legitimate image creation and editing
  • Automated or bulk generation may be restricted
  • We reserve the right to monitor and limit suspicious usage patterns
  • Enterprise plans are available for high-volume users

9. Privacy and Data Protection

  • Your privacy is important to us and is governed by our Privacy Policy

  • You consent to our data practices as outlined in our Privacy Policy
  • We implement industry-standard security measures to protect your data
  • Generated images may be temporarily stored for processing but are not used for training

10. Disclaimers and Limitations

  • Scheduled maintenance will be announced in advance when possible

Content Accuracy

  • AI-generated content may not always meet your expectations
  • We do not guarantee the accuracy, quality, or suitability of generated content
  • Generated content is provided "as is" without warranties
  • You are responsible for reviewing and approving generated content before use

Third-Party Services

  • Our Service integrates with third-party AI providers and payment processors
  • We are not responsible for third-party service availability or performance
  • Third-party services are governed by their own terms and privacy policies

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for loss of profits, data, or business opportunities
  • We are not liable for any damages arising from generated content use
  • Some jurisdictions do not allow these limitations, so they may not apply to you

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the Service in violation of these Terms
  • Content you create, upload, or generate using the Service
  • Your violation of any law or third-party rights
  • Commercial use of generated content
  • Any dispute between you and other users

13. Termination

By You

  • You may terminate your account at any time through your account settings
  • Termination does not entitle you to a refund unless specified in our refund policy
  • You remain responsible for all charges incurred before termination

By Us

We may terminate or suspend your access immediately for:

  • Violation of these Terms or our policies
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Abuse of the Service or violation of fair use policy
  • Prolonged inactivity (with 30 days notice)

Effects of Termination

  • Your access to the Service will be discontinued
  • Generated content and account data may be deleted after 90 days
  • Unused credits are forfeited upon termination
  • These Terms will survive termination where applicable

14. Modifications to Terms

  • We may update these Terms from time to time
  • Material changes will be communicated via email or platform notice 30 days in advance
  • Continued use after changes constitutes acceptance of new Terms
  • If you disagree with changes, you may terminate your account before they take effect

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

Dispute Process

  1. Informal Resolution: Contact us first at support@imagable.ai to resolve disputes amicably
  2. Formal Dispute: If informal resolution fails within 30 days, formal dispute resolution may be pursued
  3. Arbitration: Disputes may be subject to binding arbitration where permitted by law

16. General Provisions

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and us.

Assignment

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger or sale.

Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Content Moderation

  • We employ automated and manual content moderation systems
  • Inappropriate content generation attempts may result in account restrictions
